General Terms and Conditions

Here you can find the General terms and conditions of Byannedegrund Photography. These terms and conditions apply to every shoot, walk-along day, workshop, photo trip etc.

Shoots

Duration

All shoots are unlimited in duration. A dog/horse photoshoot typically lasts about 2 hours, and a corporate shoot about 3 hours. We'll take the time for your photoshoot!

Editing time

Once the client has selected the photos on their personal order page, I have five weeks to edit them. If you booked your shoot in June, July, August, or September, the delivery time is no longer than six weeks. If circumstances require longer, I will of course inform the client. I will, of course, do my best to keep the editing time as short as possible.

Photo rights

All rights to the photos remain with me at all times. This means you may not resell the photos or profit from them. If you do, I will be forced to send compensation. If you wish to purchase the rights to the photos, please contact me (copyright). There is a difference between purchasing photoshoots and purchasing the rights to photoshoots.

My photos may not be cropped in any way so that my logo is not visible. Furthermore, no additional filters may be applied to my photos, for example, for posting on social media. If this does happen after a warning, a €100 fee will be charged . You choose me as your photographer because of my style, which you appreciate. Of course, I always ask the client for permission to use the photos for the website (portfolio) and Instagram & Facebook (portrait rights).

Payments

Dutch photoshoots: If travel expenses have been quoted, these must be paid 24 hours prior to the shoot, in case of no-show.

 

I work with a 50% deposit prior to the photoshoot to secure both our time. After receiving your selection, I'll send an invoice, which must be paid first. Then I'll start the editing process and the delivery time. You'll receive an invoice from me, which you can then transfer to the bank account provided, using the invoice number.

Gift Card

The Gift Cards are valid for a maximum of 2 years and may only be used by the person and package price on the card. Gift Cards are non-returnable.

Bookings

All photoshoots are based on a specific number of people/animals. If you'd like to be photographed with your friend(s), mother, father, grandfather, or grandmother with an additional animal, this is possible for an additional €40 per person/animal (dog & horse photoshoots) or €20 per person/animal (corporate photoshoots).

All bookings exclude travel expenses. By booking, you automatically agree to the terms and conditions.

Dresses

During a shoot (mainly used in horse photography) you have the possibility to rent a dress. The dress should be handled with care. If something happens, such as the horse standing on the dress and possibly tearing it, compensation must be paid. The amount of this varies per damage.

Once a photoshoot is confirmed, it cannot be canceled within a certain timeframe without incurring a fee. Except for an exceptional, valid reason, such as death or medical reasons, the shoot will be rescheduled to another date.

 

Photoshoots Austria conditions:

Before my trip to Austria for your photoshoot, you'll receive an invoice with a deposit of half the photoshoot fee. This is to secure your spot and my time. I'll drive to Austria specifically for your requests. This takes a lot of time and energy, so there are some conditions. I appreciate your understanding.

 

If you cancel up to four weeks before the photoshoot, you'll receive your full deposit back.

 

If you cancel within 4 to 3 weeks of the photoshoot, you will be charged 25% of the fee.

(You get half of your deposit back)

 

If you cancel within 3 to 2 weeks of the photoshoot, you will be charged 50% of the fee.

(You lose the entire deposit)

 

If you cancel within 2 to 1 week of the photoshoot, you will be charged 75% of the fee.

(The down payment + half of the second remaining payment)

 

If you cancel within 1 to 0 weeks of the photoshoot, you will be charged 100%.

You will lose your deposit + I will charge you the remaining amount of the photoshoot)

 

These terms and conditions apply to all cancellation reasons submitted by the customer. Make sure you have travel insurance to cover these types of expenses.

 

Bad weather?

If bad weather is forecast for your photoshoot, I'll offer a rescheduling option. You and I will only be in Austria for a limited period, so please keep this in mind when planning your vacation. If the other options don't work out for you, your deposit will remain, and the photoshoot will be held at a later date.

 

Photoshoots Netherlands conditions:

 

If you cancel up to two weeks before the photoshoot, you'll receive your full deposit back.

 

If you cancel within 2 to 1 week of the photoshoot, you will be charged 25% of the fee.

(You get half of your deposit back)

 

If you cancel within one week to one day before the photoshoot, you will be charged 50% of the fee.

(You lose the entire deposit)

 

If you cancel on the day itself or don't show up, you will be charged 100%.

(You will lose your deposit + I will charge you the remaining amount of the photoshoot)

 

These terms and conditions apply to all cancellation reasons of the customer.

 

Bad weather?

Of course, different conditions apply in case of bad weather. If bad weather is forecast during your photoshoot, we'll work with you to find a new date to reschedule.

 

Mini shoots

The mini-shoots always have a date set by me. They always go ahead with a minimum of three participants.

 

If you cancel up to two weeks before the photoshoot, you'll receive your full deposit back.

 

If you cancel within two weeks to three days of the mini-shoot, you have the option to find a replacement for your spot. This will only happen if the new mini-shoot participant has paid their deposit no later than 24 hours before the photoshoot. If there is no replacement, a 50% charge will be made.

(You lose the entire deposit)

 

If you cancel within three days of the photoshoot or don't show up, you will be charged 100%. (You also have the option to find a replacement within three days, but experience shows that with such short notice, this is often impossible. If it does work out and the new participant officially confirms their booking within 24 hours of the photoshoot, and the deposit has been paid, you will receive your deposit back.)

These terms and conditions apply to all cancellation reasons of the customer.

 

Bad weather?

 

If bad weather is forecast during the mini-shoots, we'll work together to find a new date or suitable time to schedule the mini-shoots!

Complaints

Any complaint about the photos taken during your photoshoot must be officially notified to me by email within two days of submitting the gallery. Any complaint about the time the photoshoot itself took place must be officially notified to me by email within two days. Complaints received after this time will not be processed. I will take the complaint seriously, and together we will find a suitable solution. If the complaint concerns the photos taken and is reasonable, a new appointment will be scheduled to achieve the desired result. Refund of the deposit is not possible due to all the costs I have already incurred.

Risk

During the shoot, the photographer is not liable for anything except actions taken. Participation in a shoot and any belongings brought to the shoot are at your own risk. This applies to both material and immaterial damage.

After editing

As a photographer, I am free to fill in the photos in post-processing, as I think is appropriate and beautiful.

The photographer is not liable for the difference in quality of photos after personal use of the photos. It is also not possible to receive the unedited photos. Why? I'll gladly tell you more about that here !

Photoshop lesson

The Photoshop lesson is recorded and this video may of course not be forwarded to anyone. This lesson is meant for you and is also tailor-made for you and the video will also remain in your own possession. If the video does come into someone else's possession, I am forced to charge you the amount of the Photoshop lesson again.

Photo tour

  • The participant will receive the invoice of the booked lodge for the photo trip after the booking has taken place via email personally from Anne de Grund. The participant has 3 days (from the day of the sent invoice) to make the payment. If the amount is not paid within the agreed period, Anne de Grund can cancel the booking and pass the spot to the next participant.

  • After the payment, you are guaranteed your place in the photo trip Austria 2024.

  • If the participant cancels 2 months or less before the photo trip begins without a valid reason, the full amount will not be returned until the participant's vacated spot is filled by someone else.

  • Travel and cancellation insurance is recommended in case of illness or death. However, this is the responsibility of the participant. No refunds can be made after booking if the participant has a substitute (as discussed in the previous point).

  • The photo trip will continue at all times due to weather conditions. May is a good month in terms of weather. Anne will move all photo shoots to appropriate times should the weather not allow it.

  • The participant is responsible for a valid ID card or passport.

  • It is the participant's responsibility to check and report any allergies (the first possibility was to report it during the booking process.

  • The participant is responsible for his/her own travel and cancellation insurance.

  • The participant is responsible for arranging their own round trip to Rinnen, Austria. This is not included in the photo trip cost.

  • The participant will receive the photo trip program from Anne de Grund at some point. This may not appear on social media (including stories) and may not be forwarded. 

  • During the trip, the participant will take pictures during the photo shoot. You have the right to use these photos for your portfolio. If you want to use the photos for advertising purposes, please first ask written permission from the relevant model who is in the picture. 

  • The participant is responsible for informing Anne de Grund before April 22 if she has any allergies or other issues that Anne de Grund can take into account. 

  • Is the participant dissatisfied with the photo trip? Then there is the possibility to send in a complaint within 7 working days after the trip. The participant can never receive a refund due to costs already incurred. Anne de Grund will decide on an appropriate solution.

  • Personal data about the participants will never be forwarded or published.

  • The prices of the photo trip cannot be discussed.

  • The participant is responsible to bring his/her own equipment to the trip. Think of body + Lens(zen), memory cards, battery + charger, laptop, hard drive etc.

  • During the trip, video and photo recordings will be made for advertising the trip. Don't want to be on camera? Then you have the possibility to indicate this before May 10, 2025.

  • It is not possible to book an extra night or arrive earlier because of our other bookings before and after the trip.

  • Anne de Grund determines everything around the photo trip.
